Website terms
1. Scope and operator
This website is operated by GEXFI HK (“GEXFI”, “we”, “us” or “our”). These Terms apply when you visit gexfi.com, view product information or use the website's public features. Separate product agreements, fee disclosures, privacy notices and order terms that you accept during onboarding, application, order placement or card enrolment may also apply to your GEXFI account, wallet, exchange, transfers, multi-currency accounts, business OTC services or Visa card. If a description on this website conflicts with an applicable product agreement or the information in an order presented through your account, the product agreement and the order information you confirmed will govern that service or transaction. The card application process should identify the actual card issuer, cardholder agreement, fees and applicable restrictions. Other service providers and their terms will be identified during the relevant application or contracting process.
2. Website information and service availability
This website describes GEXFI's digital asset wallet, fiat and digital asset exchange, Visa card, multi-currency accounts, transfers and business services. Interfaces, workflows, currency pairs, example amounts and interactive demonstrations are illustrative. They are not live exchange rates, executable quotes, account balances or commitments to transact. Interacting with a demonstration does not create a real order. Service availability depends on your location, identity verification, product eligibility, partner requirements and the services available at the time. The actual transaction direction, price, fees, validity period, receipt of funds and settlement arrangements are as shown in your account and confirmed by you. We may reasonably change the scope, features and availability of services, with notice where required by applicable law or a product agreement.
3. Eligibility and accuracy of information
You must meet the age and eligibility requirements under applicable law and the relevant product agreement and provide true, accurate, complete and current information. Business customers must provide information about their entity, beneficial owners, authorised persons and relevant transactions. We may conduct identity and business verification, sanctions and fraud screening, source of funds and transaction purpose checks, and request updated information as permitted or required by law. To the extent permitted by applicable law, regulatory requirements or a product agreement, we may reject an application, restrict a feature, defer execution, suspend or terminate a service for reasonable grounds, including information that cannot be verified, suspected fraud or illegality, sanctions or source of funds concerns, or a partner requirement. Where legally permitted, we will provide notice and a review route in accordance with the relevant product agreement.
4. Transactions, funds and digital assets
Before confirming an order, check the currencies, amount, applicable quote, fees, recipient or wallet address, blockchain network and other transaction details. Blockchain transactions may be irreversible. Sending digital assets to the wrong address or over an unsupported network may make them irrecoverable. Follow the official instructions in your account; do not make a payment or transfer solely on the basis of a website demonstration. An order marked “submitted”, or the upload of proof of payment, does not mean that funds have actually arrived. We may execute an order after verifying full receipt of funds, transaction information and compliance requirements. Verification, execution, delivery and settlement are distinct stages. The final status is determined by the order record in your account and the applicable product agreement. A quote may expire; an unconfirmed or expired order does not lock in an exchange rate. Banks, payment networks, blockchains and other providers may affect processing times. Responsibility for losses caused by incorrect recipient details, wallet addresses, blockchain networks or other instructions you provide, or by actions you take without authorisation, is determined by the relevant product agreement and applicable law. We will nevertheless provide reasonable assistance with investigation and resolution where practicable.
5. Visa card and third-party services
Visa Worldwide Pte. Limited is the name supplied for the Visa entity involved in this card programme. The legal card issuer, programme manager and their respective responsibilities are those expressly identified as such on the card application page and in the cardholder agreement. Card applications, issuance, funding, use, freezing, refunds, fees and disputes are subject to the cardholder agreement, card scheme rules and applicable law. The ability to add a card to Apple Pay, Google Pay, WeChat Pay or Alipay depends on the card, device, location and support from the relevant platform. Payment scenarios shown on this website do not guarantee availability to every user, merchant or region. Multi-currency receiving accounts and other third-party services may also be subject to the relevant provider's eligibility criteria, rules and privacy notice. The provider will be identified during the application process.
6. Acceptable use
You must not use the website or services for unlawful activity, fraud, money laundering, sanctions evasion, infringement of others' rights or conduct that compromises system security. You must not access an account without authorisation, extract non-public data, distribute malicious code or interfere with the website. Keep your login credentials secure and promptly report suspected unauthorised use through your account's help function or an official website contact channel.
7. Intellectual property and external links
Unless otherwise stated, the rights in the website's text, design, graphics, trademarks and software belong to GEXFI or its licensors. You may reasonably view and save pages to learn about the services, but you may not commercially reproduce, republish or impersonate them without permission. The website may link to third-party sites or platforms. Their services are subject to their own terms and privacy policies. Check the URL and provider before leaving the GEXFI website.
8. Website availability and liability
We take reasonable steps to maintain the website's information and system security, but internet services, devices and third-party networks may experience interruptions, delays or errors. Check illustrative website content against the actual account interface and formal product documents before making a decision. To the extent permitted by law, we are not responsible for delays or interruptions caused by failures of networks, banks, payment systems, blockchains or other third parties beyond our reasonable control, or by events of force majeure. We will take reasonable steps to mitigate their effects. Unless applicable law provides otherwise, either party's liability for breach of these website Terms is limited to actual loss directly caused by the breach that was reasonably foreseeable. Neither party is liable for indirect losses or speculative lost profits or opportunities. To the extent permitted by law, you must compensate GEXFI for reasonable direct loss and expense arising from third-party claims caused by your unlawful use of the website, infringement of third-party rights or deliberate provision of false information. Nothing in these Terms excludes or restricts liability for fraud, intentional unlawful conduct, personal injury, or any liability or consumer right that applicable law does not permit us to exclude or restrict. Liability for a particular transaction and the handling of related disputes remain subject to applicable law and the relevant product agreement.
9. Changes and governing law
We may update these website Terms and display the updated date on this page. We will notify you through an appropriate channel if a material change requires notice under law or a product agreement. Continued use after an update may be subject to the updated Terms; rights and obligations under an existing transaction remain governed by the terms applicable to that transaction. These website Terms are generally interpreted under the laws of the Hong Kong Special Administrative Region, and website disputes will be handled by courts of competent jurisdiction in Hong Kong, without affecting mandatory rights that cannot lawfully be excluded in your location. A specific product agreement may specify its own governing law and dispute resolution process.
10. Contact and complaints
For website, account or product enquiries and complaints, contact info@gexfi.com or use the help function in your account. The address for legal notices to GEXFI HK is Room 602, 6/F, Kai Yue Commercial Building, No. 2C Argyle Street, Mong Kok, Kowloon, Hong Kong. Any separate complaints or external dispute resolution arrangements for a specific product are set out in its product documents.
